Two Former Patent Trial Board Judges Join Covington & Burling

Simon Frankel and Peter Chen are quoted in a Daily Journal article regarding the arrival of Chen to the firm’s Patent Office Trials Practice. According to Frankel, while the firm’s patent litigation activity spans the coasts, most of its patent office practice has been based in Washington D.C. Chen’s addition will help expand the firm’s patent practice capabilities for clients on the West Coast. “We have done a great deal of work on both life sciences and biotechnology patents and electronics and information technology patents,” Frankel says. “With his broad litigation and PTAB experience, Peter brings value for our clients across these areas.”

Chen says his experience on the bench will enable him to give clients a unique insider perspective. “I was privileged to preside over these [America Invents Act] trials and to have participated in the PTAB management.”

Chen adds that he expects to see the number of case filed with the board increase in the future, especially post-grant review proceedings, which only apply to patents filed after 2012. “There are potentially more bases [in post grant reviews] for a challenger to raise a challenge” on subject matter eligibility.
