ALI Gives Final OK On Liability Insurance Guidelines

May 22, 2018, Law360

In an article regarding the approval of the final iteration of the Restatement of Law, Liability Insurance, Law360 highlights David Goodwin and John Buchanan's efforts that resulted in deleting a provision of the guidelines that would have allowed an insurer to deny coverage for its policyholder's costs to defend a claim that the policyholder became aware of before the policy's inception. According to Goodwin and Buchanan, that provision, if adopted, would have given insurers more grounds for refusing to defend their policyholders.
