US Moves to Expand Sweep of Foreign Deal Review Powers

Mark Plotkin is quoted in the Financial Times regarding U.S. Treasury’s announcement that it will introduce new regulations expanding the powers of the Committee on Foreign Investment (CFIUS) to further scrutinize foreign investments involving sensitive technology, infrastructure, personal data, and real estate. Mr. Plotkin says, “The regulations reflect considerable restraint on the part of the Committee. They acted very deliberately in trying to tailor the proposed regulations to true national security needs. The proposed regulations also show a real sensitivity to the perception of CFIUS as an obstacle to foreign investment.”
