Ashley Bass, co-chair of Covington’s Antitrust Litigation Practice Group, is a partner in the firm’s Washington, DC office. Her practice focuses on antitrust issues, including litigation, government investigations, counseling matters, and merger analysis.  Ms. Bass particularly focuses on private antitrust litigation involving multidistrict class actions and has advised clients in some of the largest, most complex private antitrust litigations in the US.  Ms. Bass has also advised clients on antitrust investigations by numerous governmental agencies, including the Department of Justice, the Federal Trade Commission, and the European Commission.  Her clients span a wide range of sectors including pharmaceuticals, music, shipping and consumer goods.

  • In re Rotavirus Vaccines Antitrust Litigation. Representing Merck in consolidated class action in Eastern District of Pennsylvania asserting antitrust challenges to Merck’s contracting practices that allegedly excluded competition from other pediatric vaccine manufacturers. 
  • In re K-Dur Antitrust Litigation.  Represents Schering-Plough (now Merck) in multidistrict class action litigation consolidated in the District of New Jersey alleging violations of antitrust laws arising out of settlements of patent litigation with generic drug producers involving so-called “reverse payments.”
  • American Federation of State, County and Municipal Employees District Council 37 Health & Security Plan v. Bristol-Myers Squibb Co.  Represents Bristol-Myers Squibb in a class action lawsuit in the Southern District of New York alleging that BMS’ co-pay assistance program for its blockbuster drug Abilify® violates RICO and Robinson Patman Act § 2(c).
  • In re Nexium Antitrust Litigation.  Represents AstraZeneca in multidistrict class action litigation consolidated in the District of Massachusetts involving alleged violations of the antitrust laws arising from the settlement of Hatch-Waxman pharmaceutical patent litigation.
  • In re Wellbutrin XL Antitrust Litigation.  Represents Valeant Pharmaceuticals International (formerly Biovail Corporation) in class action litigation consolidated in the Eastern District of Pennsylvania involving alleged violations of the antitrust laws concerning allegations of sham Hatch-Waxman pharmaceutical patent litigation.
  • Precision Associates, Inc., et al v. Panalpina World Transport (Holding) Ltd, et al.  Represents Expeditors International of Washington, Inc. in a class action against freight forwarders alleging a conspiracy to fix the prices of freight forwarding services sold in the United States in violation of the antitrust laws.
  • Arminak & Associates v. MeadWestvaco Corp.  Represented MeadWestvaco in Section 2 Sherman Act case alleging monopolization of trigger sprayers. Obtained partial summary judgment significantly narrowing the case.
  • In re Digital Music Antitrust Litigation.  Represented Bertelsmann, Inc. in multidistrict class action litigation alleging a conspiracy to violate the antitrust laws to fix the price of Internet music and to prop up the market for compact disks. Motion to dismiss granted on behalf of our client.
  • United States v. Kuehne.  Represented prominent attorney charged with money laundering, wire fraud and obstruction of justice. Obtained pre-trial dismissal of multiple counts, as well as a landmark decision by the Eleventh Circuit Court of Appeals, following which the Department of Justice voluntarily dismissed the remaining counts of the indictment.

  • Successful representation of a Togo native in her petition for asylum in the United States.
  • Successful representation of two District of Columbia citizens in their complaints against two Metropolitan Police Officers for harassment, use of unnecessary/excessive force and discriminatory treatment (following a full administrative hearing).
