Alex Hastings advises clients across a broad range of government contracting issues, including advising clients in transactional matters involving government contractors and assisting defense contractors and pharmaceutical companies in securing and performing government contracts.
Mr. Hastings also advises clients concerning best practices in e-discovery. He assists in investigations and litigations that involve complex e-discovery issues and has represented clients in matters involving the U.S. Department of Justice, Securities and Exchange Commission and the United States International Trade Commission.
Mr. Hastings’ government contracts experience includes advising clients regarding new developments in regulatory requirements, including the Federal Acquisition Regulation’s (FAR) anti-human trafficking requirements and the FAR and Bayh-Dole Act’s intellectual property provisions. Mr. Hastings also provides due diligence regulatory advice to clients contemplating the acquisition of government contracting entities or assets.
Mr. Hastings’ e-discovery experience includes advising a wide-array of clients on best practices in information governance and document collection and assisting clients develop effective mobile device and document management policies.
Mr. Hastings also maintains an active pro bono practice and routinely writes on issues related to government contracts and e-discovery.
- Representation of defense and pharmaceutical contractors and private equity firms in the sale and acquisition of government contractors and assets, involving issues relating to compliance concerns, novation, subcontracting, and government reimbursement of costs.
- Representation of pharmaceutical companies regarding the Bayh-Dole Act and intellectual property protections under the FAR, DFARS, and other agency supplements.
- Advise multi-national companies regarding best practices in e-discovery, including international data preservation and collection measures.
- Representation of several contractors in securing favorable outcomes in False Claims Act investigations.
- Advise government contractors regarding various requests for proposals from state and local agencies.
- Advise regarding compliance with supply chain regulations, including the application of the Trade Agreements Act to pharmaceutical and electronic products.
- Advise regarding measures to identify, avoid, and mitigate organizational conflicts of interest.
- Advise government contractors related to FAR, DFARS, and HHSAR requirements, including compliance with the newly-revised anti-human trafficking rule.
- Representation of government contractors in bid protests against federal agencies, including the Defense Health Agency and United States Navy, before the United States Court of Federal Claims and the U.S. Government Accountability Office.
- Representation of pharmaceutical manufacturer in investigation by the U.S. Department of Justice regarding compliance with Current Good Manufacturing Practices (cGMP).
- Advise various types of companies concerning an array of document preservation and data privacy issues.
