Scott Levitt has twenty years of experience representing policyholders in numerous types of insurance coverage claims. These matters include cyber-risk, mass tort, asbestos, silica, mixed dust, environmental, product liability, employment discrimination, errors and omissions, first-party losses, crime and employee dishonesty. Mr. Levitt has successfully represented policyholders in insurance recovery proceedings in federal and state trial and appellate courts around the U.S., as well as in mediation and international and domestic arbitrations. Mr. Levitt's practice often involves negotiating and implementing complex settlements involving multiple parties outside of litigation.

  • Successfully pursued recoveries from cyber and general liability insurers in some of the largest data breaches to date, representing three large retailers and one payment card processor.
  • Assist clients in analyzing, and recommending enhancements to, current and prospective cyber-risk, E&O, D&O and other coverages.
  • Representing Class I railroads in pursuing coverage for liabilities and loss arising out of a train derailment.
  • Representation of manufacturers targeted by asbestos plaintiffs’ bar in litigation and negotiation of complex insurance settlements.
  • Obtained defense coverage for hotel accused of defaming and disparaging former employees.

Pro Bono

  • First-chaired federal jury trial representing lesbian couple accused of arson and fraud by their homeowner’s insurer.
  • Litigated and obtained a settlement under a travel accident insurance policy issued to a wildlife conservation association on behalf of families whose relatives died in a helicopter crash.
  • Obtained asylum in Immigration Court for several foreign nationals who were the victims of persecution because of their religion, ethnicity, or political affiliation.
