Civil Litigation

  • Secured dismissal, and Seventh Circuit opinion affirming dismissal, of copyright infringement action against major pharmaceutical joint venture involving use of patient education materials for branded pharmaceutical product.
  • Secured dismissal of complaint asserting breach of contract and tort claims against a real estate firm following break-up of a joint venture with an investment firm.
  • Obtained summary judgment for branded pharmaceutical company of Lanham Act claim brought by generic competitor based on promotional statements consistent with the FDA-approved product label.
  • Led defense of government contractor against wrongful death claims arising from mass shooting by employee of a subcontractor. 
    • Defended major pharmaceutical company against RICO and state law claims by the nation’s largest insurance companies involving products allegedly produced in violation of Good Manufacturing Practices.
    • Successfully defended pharmaceutical company in two-month trial in “pay-for-delay” case brought by the FTC challenging settlement of patent infringement cases.
    • Represented pharmaceutical company in federal securities fraud class action alleging failure to disclose violations of current Good Manufacturing Practices.
    • Represented Intel against claims by AMD alleging monopolization of the microprocessor market through alleged loyalty rebates and other conduct.  
    • Represented a leading mobile device company in antitrust and breach of contract litigation arising from competitor’s assertion of Standard Essential Patents.
    • Defended a major financial institution in action alleging industry-wide conspiracy to rig bids at tax lien auctions.
    • Represented a leading agriculture company in DOJ monopolization investigation involving allegations of “product hopping” and refusal to deal with a competitor.
    • Obtained summary judgment for Rockwell-Collins of competitor’s antitrust claims alleging it withheld technical information needed to interface with its avionics systems.
    • Represented the Republic of Uruguay in international arbitration following the failure of Uruguay’s largest private bank.
    • Represented pharmaceutical and biotech companies in arbitration and mediation of product licensing disputes.

    White Collar Defense and Investigations

    • Successful representation of public company in multi-year federal criminal investigation of fraud allegations involving specialty finance business.
    • Represented prominent attorney charged with money laundering, wire fraud and obstruction of justice, obtaining pre-trial dismissal of multiple counts and a landmark decision by the Eleventh Circuit, followed by voluntarily dismissal of the remaining counts.
    • Successful representation of public company and top executives in SEC investigation involving initial public offering.
    • Successful representation of partners of professional services firm in money laundering investigation.
    • Represented former CFO of Adelphia Communications in appeal of criminal convictions for securities and bank fraud, resulting in partial reversal and reduced sentence.
    • Successful representation of CEO of management consulting firm in government investigation involving allegations of fraud in government contracting program.
    • Successful representation of owner of construction firm in criminal investigation involving ransom payments made to the Colombian FARC.
    • Successful representation of cardiologist in federal criminal investigation of allegations of inappropriate stenting practices.

    • Led a team of Covington attorneys representing the NAACP in litigation ending with the removal of Confederate names and mascots at two public schools in Virginia.
    • Leading a team of Covington attorneys working with the ACLU to bring constitutional challenge to President Trump’s "Muslim Ban."
    • Led a team of Covington attorneys in successful challenge to Michigan’s practice of denying driver’s licenses to immigrant youth authorized to live and work in the U.S. under the DACA program.
