Elizabeth Upton is a member of the Election and Political Law Practice Group in the Washington, DC office, representing and counseling corporate, political, and individual clients in matters before government agencies and Congress. Ms. Upton defends clients in high-profile congressional investigations before House and Senate Committees, as well as in criminal and civil government investigations before the Public Integrity Section of the Department of Justice and the Federal Election Commission. She has experience assisting companies in responding to formal and informal inquiries, requests, and subpoenas for documents, information, and testimony, and has experience preparing senior executives to testify before congressional committees. Prior to joining Covington, Ms. Upton served as a Law Clerk to the U.S. Senate Permanent Subcommittee on Investigations (PSI).

Political and Election Law

  • Advising corporate (for-profit and non-profit), political, and high net worth individual clients, including candidates, PACs, Super PACs, and trade associations, regarding:
    • federal, state, and local campaign finance laws and regulations;
    • federal, state, and local pay-to-play rules; and
    • federal, state, and local lobbying and ethics law.
  • Advising clients on Foreign Agents Registration Act (FARA) compliance.
  • Representing multiple parties in campaign finance investigations by the Federal Election Commission.
  • Representing multiple private equity firms in conducting political law due diligence for mergers and acquisitions.

Congressional Investigations

  • Representing multiple major financial institutions in investigations by the House Committee on Financial Services.
  • Representing several companies involved in investigations by the House Select Subcommittee on the Coronavirus Crisis.
  • Representing a medical distributor in an investigation by the House Energy & Commerce Committee.
  • Representing a Fortune 500 company in a data breach investigation by the U.S. Senate Permanent Subcommittee on Investigations.
  • Representing a global entertainment company in an investigation conducted by the Department of Justice Public Integrity Section.
  • Assisting in the preparation of executives of large companies for congressional appearances.
  • Performing diligence and congressional investigation risk analysis and preparation for a major pharmaceutical company.

Pro Bono

  • Representing individuals experiencing homelessness in challenging the constitutionality of the District of Columbia government’s destruction of unattended personal belongings during “encampment” clearings, Proctor et al. v. District of Columbia, No. 18-cv-701 (D.D.C.).
  • Representing the Brady Center in various matters, including legal analysis to support Brady's policy agenda development.
  • Providing short-term legal services through the Domestic Violence Civil Protection Order Clinic participants seeking civil protection orders in DC Superior Court.
  • Preparing country conditions reports and indices on the treatment of LGBTQ and HIV-positive individuals in Brazil for use in supporting asylum applications.
  • Representing a nonprofit on investigation and development of a potential legal challenge to Virginia's school funding system
  • Guiding DC low-income residents through applications for housing tax credits.
